Legal Associate – Job Description (SARFAESI Focus)

1. Handling SARFAESI Proceedings (Section 13)
   Manage actions under Section 13 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, including issuance of demand notices under Section 13(2) and taking symbolic/physical possession under Section 13(4) in case of borrower default.

2. Drafting and Vetting Legal Notices
   Draft, review, and issue demand notices, possession notices, and related correspondence in compliance with statutory timelines and procedural requirements under Section 13.

3. Section 14 Applications (Assistance from Magistrate)
   Prepare and file applications under Section 14 before the Chief Metropolitan Magistrate (CMM) or District Magistrate (DM) to obtain orders for physical possession of secured assets.

4. Court & Tribunal Representation Support
   Coordinate matters before the Debt Recovery Tribunal (DRT) in cases where borrowers challenge actions taken under Section 13(4), and assist panel advocates in litigation management.
