AGENT AGREEMENT

1. SCOPE OF WORK

Agent will recruit and supply qualified Caretakers, ANM, GNM, and Nursing Staff for home care services. Agent confirms that all candidates are genuine and medically fit.

2. PAYMENT TERMS

• Incentive per staff: ₹1,800 – ₹2,500 (based on slab)

• Payment cycle: Monthly

Payment Conditions:

• 50% after 15 days continuous duty

• 100% after 30 days continuous duty

• No payment if staff leaves within 7 days

3. INCENTIVE SLAB

Monthly Joining Incentive per Staff

1–5 staff ₹1800

6–10 staff ₹1900

11–20 staff ₹2100

21–30 staff ₹2200

30+ staff ₹2500

4. SECURITY & PENALTY CLAUSE

• Agent must deposit refundable security of ₹5,000 (optional but recommended)

• Fraud, fake candidate, or data misuse → security forfeited

• Company can deduct incentive for any loss caused by agent

5. REPLACEMENT POLICY

• If staff leaves within 7 days → No incentive

6. NON-COMPETE & NON-CIRCUMVENTION

• Agent cannot directly deal with company clients

• Agent cannot take staff or client to another company

• Violation → ₹50,000 penalty + legal action

7. AGENT RESPONSIBILITIES

• Verify ID proof of candidates

• Explain job terms clearly to staff

• Ensure minimum 30 days commitment

• Maintain discipline and communication

8. CONFIDENTIALITY

Agent agrees not to share:

• Client details

• Staff database

• Company pricing or system

Violation → legal action

9. TERMINATION CLAUSE

Company can terminate immediately if:

• Fraud or fake hiring

• Poor performance

• Rule violation

Agent will not claim any pending incentive after termination (if rules violated)

10. DISPUTE RESOLUTION

Any dispute will be subject to jurisdiction of Bangalore, Karnataka court.

11. AGREEMENT VALIDITY

This agreement is valid for 12 months from signing date.

12. DECLARATION

Agent agrees to all terms and confirms compliance.
