Job Summary
We are seeking a seasoned, results-oriented Advocate (Male) to join our Legal Resolution Team as Senior Counsel. The successful candidate will be a versatile legal professional capable of seamlessly transitioning between drafting complex commercial agreements, handling ad-hoc non-litigation matters, and leading high-pressure negotiations and multi-jurisdictional litigation.
This role demands expert communication skills, a collaborative team-player mentality, and adept client management. It requires a profound understanding of the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), Company Law, and B2B legal frameworks to effectively resolve disputes both out-of-court and through the judicial system.
Key Responsibilities
1. Strategic Dispute Resolution
Risk Assessment: Analyze complex B2B disputes to provide comprehensive risk assessments and strategic roadmaps for financial recovery.
Liability Identification: Identify criminal liabilities in commercial breaches, focusing on Dishonest Misappropriation (Section 316 BNS) and Cheating (Section 318 BNS). Ensure compliance and strategic leverage utilizing the Negotiable Instruments Act, General Commercial Laws, GST regulations, and MSME ODR Management frameworks.
Feasibility Analysis: Perform cost-benefit analyses to determine the viability of Pre-Institution Mediation versus immediate Litigation.
2. Expert Drafting & Legal Communications
Commercial Instruments: Draft and review diverse B2B agreements, including Master Service Agreements (MSAs), Supply Agreements, and Partnership Deeds etc.
Notices & Complaints: Formulate high-impact Demand Notices, Criminal Notices, and Police Complaints, ensuring technical precision, statutory accuracy, and consistency in interest calculations.
Corporate Documentation: Draft Minutes of Meeting (MoM) and maintain a consistent "legal voice" across all corporate communications to ensure documents, ledgers, and signed acknowledgments are entirely trial-ready.
3. Advanced Negotiations & Settlements
Pre-Litigation Strategy: Assist the lead negotiator and senior legal counsel during pre-litigation phases to secure advance refunds and resolve outstanding dues.
Binding Agreements: Draft legally binding Settlement Agreements and Consent Terms that provide finality and insulate the firm from future liabilities.
4. Comprehensive Litigation Management
Representation: Represent the company or closely supervise external counsel in Civil Recovery Suits, Commercial Courts, and Criminal proceedings.
End-to-End Filing: Manage the complete filing process, including the preparation of Evidence Briefs, tracking RTGS transaction trails, and ensuring all documentation is GST-compliant.
Required Skills & Qualifications
Education & Credentials: LL.B. and/or LL.M. from a reputed institution. Active Bar Council enrollment is a strong added advantage.
Experience: Minimum of 1 to 2 years of rigorous experience in Commercial Litigation and high-value B2B negotiations.
Statutory Expertise: Mastery of the BNS (2023), BNSS (2023), Indian Contract Act, and the procedural workings of Commercial, Civil, and Criminal Courts.
B2B Proficiency: Proven track record in the logistics, manufacturing, or fintech sectors, with specific expertise in tracing RTGS payments and managing GSTIN-related legal issues.
Soft Skills: Exceptional command of legal English, aggressive yet highly professional negotiation tactics, and a solution-oriented "fixer" mindset.
