We are seeking a proactive Legal and Compliance Officer who specializes in Industrial and Labor Laws, Civil and Criminal Law, and Regulatory Compliance relating to Factory Licensing, Pollution Control Board permissions, and other statutory licenses (e.g., Trade License, Shops and Establishment Registration). The role will ensure full legal compliance across operational, employment, environmental, and regulatory aspects of the organization.
Key Responsibilities:
Industrial and Labor Compliance:
Ensure compliance under Industrial Disputes Act, Factories Act, Contract Labour Act, Payment of Wages Act, and related labor laws.
Handle employment law advisory, disciplinary actions, trade union negotiations, layoffs, and industrial dispute resolution.
Represent the company before Labor Commissioners, Labor Courts, and Industrial Tribunals.
Factory Licensing and Regulatory Compliance:
Manage timely application, renewal, and compliance of Factory Licenses under the Factories Act, 1948.
Ensure end-to-end compliance with statutory requirements for manufacturing and operational facilities.
Liaise with Directorate of Factories and Boilers and other authorities for inspections and approvals.
Pollution Control Compliance (CTE/CTO):
Manage applications for Consent to Establish (CTE) and Consent to Operate (CTO) from the State Pollution Control Board.
Ensure ongoing environmental compliance under Water Act, Air Act, Environment Protection Act, and related regulations.
Handle monitoring, reporting, and renewal of environmental clearances, hazardous waste authorizations, and emissions compliance.
Liaise with external consultants and authorities for environmental audits and regulatory inspections.
Trade License and Other Statutory Approvals:
Obtain and renew Trade Licenses, Shops and Establishments Registrations, and any other mandatory municipal or state licenses.
Ensure timely filing of returns and submissions to regulatory bodies.
Coordinate with local government bodies for any regulatory permissions or clarifications.
Civil and Criminal Law Support:
Manage civil litigation, including contractual disputes, property matters, recovery suits, and regulatory compliance disputes.
Handle criminal matters such as employee misconduct, theft, fraud, or regulatory violations.
Represent the organization in courts, police stations, and before enforcement agencies as necessary.
Internal Compliance & Advisory:
Conduct legal audits of sites/factories for compliance with labor, safety, and environmental laws.
Train internal teams on statutory obligations relating to factory operations, pollution control, licenses, and employee relations.
Maintain regulatory compliance dashboards and prepare reports for senior management.
Qualifications:
Bachelor's Degree in Law (LL.B.) from a recognized institution (mandatory).
Master’s degree in Environmental Law, Labor Law, or Corporate Law (preferred).
Experience:
4–6 years of experience in legal and compliance roles, preferably in manufacturing sectors.
Hands-on experience managing factory licenses, pollution board consents, and labor law compliance.
Skills Required:
Strong knowledge of Factory Act, Pollution Control laws, Municipal Licensing, Labor Laws, and Criminal Laws.
Experience dealing with regulatory authorities like PCB, Labour Department, Inspector of Factories, and Municipal Corporations.
Strong drafting, negotiation, and litigation management skills.
Ability to manage high-pressure compliance deadlines and regulatory inspections.
Excellent communication and stakeholder management abilities.
Ethical, organized, and process-oriented approach.
Preferred Certifications:
Environmental Law Certification.
Compliance Management Course.
Industrial Safety and Regulatory Certification (Optional).
